Terms of Service

The agreement between you and Acumen for using the Service. Effective September 2, 2026 (v1.1).

In plain terms

  • Acumen helps you develop professional judgment through AI-assisted case work, grading, and coaching — it does not replace your instructor’s final academic judgment or a licensed professional’s advice.
  • You keep ownership of the work you submit. Acumen uses it to grade, coach, and support your course, and — only in de-identified, aggregate form — to improve the platform.
  • AI-generated feedback and scores can be wrong. Treat them as coaching input, not a guarantee of a grade or a substitute for your own judgment.
  • Some classes carry a one-time access fee, processed securely through Stripe. Acumen never sees or stores your card number.
  • You’re responsible for keeping your account credentials to yourself and for activity under your account.

1. Acceptance of these Terms

These Terms of Service (“Terms”) govern access to and use of Acumen (the “Service”), operated by Aaron Jacob, on behalf of Acumen (“Acumen,” “we,” “us”). By creating an account, you confirm that you’re able to enter into this agreement and that you agree to these Terms and to the Privacy Policy, which is incorporated by reference. If you don’t agree, don’t create an account or use the Service.

If you’re using Acumen as part of a course, your institution or professor may also have its own policies (academic integrity rules, grading policies, syllabus terms) that apply alongside these Terms. Where those conflict with academic matters like grading, your institution’s policies control; these Terms govern your use of the Service itself.

2. What Acumen Is

Acumen is a platform for developing professional judgment in accounting, finance, and related disciplines. It includes a library of case studies, an AI grading engine (“Rubrix”) that evaluates submitted work, an AI-driven Socratic coach (“Judgment Coach”), and analytics for professors and institutions.

Acumen is a judgment-development and coaching tool. It is not a substitute for professional accounting, tax, legal, financial, or other advice, and nothing generated by the Service should be relied on as such. Where Acumen is used in an academic course, your instructor — not Acumen — determines your final grade; AI-generated scores and feedback are an input to that process, not the outcome of it, except where your instructor has explicitly said otherwise for a given assignment.

3. Accounts and Eligibility

You need an account to use most of the Service. Accounts are created either by signing up directly (typically students, using an institutional or personal email) or by invitation from a professor or administrator (typically faculty and teaching assistants). You agree to provide accurate information, keep your login credentials confidential, and notify us promptly of any unauthorized use of your account. You’re responsible for activity that occurs under your account, whether or not you authorized it, except to the extent it results from our failure to safeguard the Service.

One account per person. You may not share your account, let someone else complete your work under your account, or create an account on behalf of someone else without authorization.

4. Your Content

“Your Content” means the memos, analyses, interview responses, uploads, and other work you submit through the Service, along with anything you enter into Judgment Coach conversations — including, on Conversation Cases where your class has voice mode enabled and you choose to use it, the audio you speak and its transcribed text.

You retain ownership of Your Content. By submitting it, you grant Acumen a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display Your Content as needed to operate the Service — including sending it to our AI providers to generate grades, feedback, and coaching responses, showing it to your instructor and any teaching assistants for your course, and, in de-identified and aggregated form only, using it to analyze and improve Acumen’s grading and coaching quality. We do not sell Your Content, use it for advertising, or use it to train a third party’s general-purpose AI model. See the Privacy Policy for the full detail on how submitted work is handled.

You’re responsible for Your Content — that you have the right to submit it, that it doesn’t infringe anyone else’s rights, and that it complies with your institution’s academic integrity policies. Don’t include another person’s personal information, confidential information you’re not authorized to share, or anything unlawful in what you submit.

5. AI-Generated Content

Grading, feedback, and coaching responses on Acumen are generated in whole or in part by AI systems (currently including Anthropic’s Claude models, and — for the optional voice mode, where enabled — Deepgram’s speech-to-text and text-to-speech models). AI-generated content can be incomplete, imprecise, or wrong, notwithstanding the effort put into rubric design and prompt engineering. You should apply your own judgment — which is, after all, the point of the exercise — rather than treating any AI output as authoritative. Where a human reviewer (an instructor or TA) is part of your course’s grading workflow, their review controls over the AI-generated score.

6. Payments

Some classes require a one-time access fee to join, set by the professor for that class and disclosed before you pay. Payments are processed by Stripe; Acumen does not receive or store your full card number. Fees are generally non-refundable once paid, except as required by law or as your professor or institution specifically provides for that class. If a payment doesn’t go through or a class listing is misconfigured, contact us and we’ll sort it out.

7. Acceptable Use

You agree not to: use the Service to violate your institution’s academic integrity policies (for example, submitting work you didn’t do, or using Acumen to generate a final work product where doing so isn’t permitted by your course); attempt to reverse-engineer, scrape, or extract the case library, rubrics, or underlying prompts at scale; probe, disrupt, or attempt to gain unauthorized access to the Service or other users’ data; upload malicious code; impersonate another person; or use the Service for any purpose that’s unlawful or that this Agreement doesn’t otherwise permit.

We may investigate suspected violations and take appropriate action, including suspending or terminating access, and where academic integrity is implicated, notifying the relevant institution.

8. Intellectual Property

Acumen’s case library, rubrics, Judgment Coach design, software, and branding are owned by Acumen or its licensors and protected by intellectual property law. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your own educational or professional development — not to reproduce, redistribute, or create derivative works from the case materials, rubrics, or platform itself.

9. Privacy

Our Privacy Policy describes what information we collect, how we use it, and the choices you have. It’s part of these Terms.

10. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Acumen disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, or that AI-generated grading or feedback will be accurate, complete, or suitable for any particular purpose. Acumen is a professional-judgment development tool, not a source of professional accounting, tax, legal, or financial advice, and nothing in the Service should be relied upon as such.

11. Limitation of Liability

To the fullest extent permitted by law, Acumen and its personnel won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Service. Acumen’s total liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid Acumen in the twelve months before the claim arose, or (b) $100. Some jurisdictions don’t allow certain liability limitations, so parts of this section may not apply to you.

12. Termination

You may stop using the Service and request account deletion at any time by contacting us. We may suspend or terminate your access if you violate these Terms, if required by your institution, or if we discontinue the Service, with notice where reasonably practical. Sections of these Terms that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and dispute resolution — will survive.

13. Changes to These Terms

We may update these Terms as the Service evolves. If we make a material change, we’ll update the effective date below and, where practical, prompt you to review and re-accept the new version at your next login. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles. Before filing a claim, we ask that you first contact us at aaron@acumenlabs.app so we can try to resolve the issue directly — most things are fixable without lawyers. Any dispute that isn’t resolved that way will be subject to the exclusive jurisdiction of the state and federal courts located in Utah.
